Your Legal Rights and Your Information: How Our Terms of Service Guard You!

You now irrevocably agree to abide by the mentioned terms and improved offerings when opening an account and accepting the service agreements offered by Genius Education Management. Genius Education Management System will provide all-inclusive services in compliance with the Terms of Service, integrating cutting-edge tools and resources to improve the general administration of your institution. These Service Terms will encompass any additional features or improvements to the current contract.

Users agree to be governed by any changes to the User Terms published on the Genius Education Management website. Users agree to receive updates regularly. By using the service in the future, you agree to the terms and conditions stated in this Terms of Service and the Genius Education Management Privacy Policy that goes with it.

Term of Account

  • You must submit accurate and current information throughout the user account registration analysis, specifically your role inside the institution and any pertinent identification numbers to effectively use the Services. If disparities are discovered, Genius Education Management reserves the right to confirm information you have submitted and to suspend or cancel your account.
  • You understand that Genius Education Management will use the email address you provide as the primary means of communication.
  • You keep your password private; Genius Education Management disclaims all liability for any illegal access or consequential damages arising from your failure to do so.
  • You retain complete control over all material produced and uploaded using your Genius Education Management Account, including text, images, and related materials.
  • Any breach or violation of any term in the Terms of Service, as determined solely by Genius Education Management, will result in the immediate termination of your services and, if required, legal action against you.

Registration of Accounts

  • The Account Owner consents to ensure that access is restricted to those people approved by the institution and to maintain precise documentation of every authorized individual who uses the service on its behalf.
  • You further attest that you have the right power to bind your institution to these Terms of Service by signing up for the service on behalf of your institution.
  • If required, Genius Education Management retains the right to use your email address to create an Online Payment Gateway account for you after you join the service.
  • Deactivating any payment accounts you do not want to keep active is your responsibility. You are entirely accountable for maintaining the Payment Gateway Account. You must delete any payment accounts you do not want to stay open.

General Conditions

  • If someone misuses or gains unauthorized access to the Genius Education Management Service, your account will be canceled immediately, and legal action may follow. All disputes shall be resolved by Ahmedabad, India's laws and regulations. You acknowledge that you have read, understood, and will comply with all of the terms and conditions stated in this Terms of Service and Privacy Policy before registering as a member
  • Account users can access specialized technical support via several platforms listed on the website.
  • Except for any regulations that would result in the application of laws from another jurisdiction, these Terms shall be governed by and construed in conformity with the applicable laws of India. The parties irrevocably and consent to the exclusive jurisdiction of the courts in Mumbai, India to resolve any issues arising out of or relating to these Terms of Service. The Unified Commercial Code is specifically rejected in the above Terms of Service as being applicable in all jurisdictions.
  • By accepting these terms of service, you agree that Genius Education Management may change them at any time by posting the revised and translated versions on the company's website, http://www.geniuserp.com. Such an upgrade to the terms of service is effective as of the posting date. Following posting the modified Terms of Service to Genius Education Management's website, you are deemed to have accepted and agreed to the revised Terms of Service if you continue to use the Services. Continue using the Service only if you accept all changes to the Terms of Service.
  • It is your responsibility to make sure your activities are compliant with all applicable local, national, and international laws. You are also prohibited from using the Genius Education Management Service in a way that violates the rights of others, including but not limited to inventor property rights. You agree to abide by all applicable laws, rules, and guidelines about using the Service.
  • Recognizing that reverse engineering, decompiling, or disassembling any portion of the Service is prohibited, you also commit to upholding Genius Education Management's intellectual property rights at all times.

  • No matter how our site, our services, or these Terms of Service are used or related to, Genius Education Management or our providers will never be held responsible for lost profits or any other unusual, coincidental, or significant harm. You also consent to release and hold harmless us, our affiliates, and each of their officers, directors, workers, and agents from any obligations, claims, demands, and damages, including reasonable legal fees, resulting from anything you do or don't do when using the services, from breaking our terms of service to breaking any applicable laws or rules.
  • We make no guarantees regarding the Service's ability to suit your needs or that it will always function without interruption or error.
  • Genius Education Management offers no guarantees on the continuity, promptness, security, or error-free operation of the Service.
  • Genius Education Management disclaims all responsibility for the accuracy or dependability of any outcomes that may be attained via the Service.
  • Genius Education Management makes no guarantees as to the results of using any features, products, or services acquired through the Service, nor does it promise that any problems or errors will be fixed right away.

Genius Education Management Rights

  • If there is a dispute about who is the rightful owner of the Genius Education Management Login Account, we reserve the right to change, suspend, or stop the service at any time. This will allow us to take the appropriate steps to protect the integrity of the account.
  • We reserve the right, at any time, for any reason, and without previous notice, to change or stop providing the Service.
  • We reserve the right, but are not required, to remove any User Content that violates these Terms of Service, and applicable laws, or that is harmful, threatening, crude, or otherwise inappropriate. We also reserve the right to take down any content that crosses the rights of third parties.
  • Any kind of harassment—verbal or written—aimed at any Genius Education Management member, officer, or staff member will result in the instant cancellation of your account.
  • Genius Education Management disclaims all liability for any errors or omissions that may arise and makes no guarantees regarding the reliability or accuracy of any web content made available through the Service.
  • employees and affiliates of Genius Education Management may represent Genius Education Management as a client or partner and may participate in competing activities without your permission.
  • We reserve the right to request the relevant paperwork in case of a dispute over Account ownership to determine or confirm Account proprietorship. The supporting documentation may include but need not be limited to, a scanned copy of your business license or permit and a government-issued photo ID for reference.
  • Genius Education Management has the full authority to determine authentic Account ownership in our sole discretion and to transfer an Account to its rightful owner. Genius Education Management retains the right to temporarily deactivate an Account until the disputing parties resolve the issue if we cannot reasonably identify the legitimate Account owner.

Waiver And Complete Agreement

  • Genius Education Management does not forfeit any of its rights under these conditions for use in the future if it does not use or enforce any of those rights. The agreement between you and Genius Education Management is embodied in these terms and conditions, which take precedence over any earlier understandings or agreements. A right or provision of the Terms of Service shall not be deemed waived by Genius Education Management's omission to assert or enforce such right or provision. You and Genius Education Management agree that the current Terms of Service, which govern your use of the Service and constitute the entire agreement between you and Genius Education Management, supersede any prior agreements or understandings, including any earlier versions of the Terms of Service.
  • Customer content and intellectual property: Everything you share is still your property, and you are responsible for it.
  • The content you provide for the Genius Education Management service is not subject to any intellectual property rights claims by us. You maintain control over every piece of content you upload. Easily deactivate your Account to remove your Genius Education Management Portal altogether.
  • The User-Generated Content you upload to Genius Education Management is still your property. The only person who can guarantee that the content complies with relevant laws and guidelines is you.
  • We value your privacy and will only share it with third parties when necessary to complete a service. Anything you provide us that isn't publicly available is considered private info. Information that was accessible to everyone at the time of disclosure, information that later became accessible without any violation on our part, or information that was lawfully received from a third party without breaching their confidentiality duties are not considered confidential information.
  • All intellectual property on the Portal, including brand names and logos, will always belong to Genius Education Management and may only be used for marketing and promotional purposes.

Payment Of Fees

  • Your debit or credit card on file will be charged immediately for any additional fees or overages, and you will have seven days to pay off any outstanding sums. If you are eligible for tax exemption, please present your current release certificate before completing the purchase to avoid being charged taxes. There are no tax refunds for taxes that have already been paid.
  • The fees that apply specifically to your use of the Online Service and Payment Services are known as "Subscription Fees." You are also liable for any other expenses that may arise, including Transaction Fees ("Transaction Fees") for processing transactions made through your Account and Additional Fees for purchasing any other products or services, including apps, domain names, or Third Party Services. The "Fees" are the Subscription Fees, Transaction Fees, and Additional Fees taken as a whole. Once paid, subscription fees are not refundable.
  • You must always have a working debit or credit card on you to pay for any one-time or recurring expenses. Genius Education Management will charge a debit or credit card account (referred to as an "Authorized Card") when you give Genius Education Management permission. Until the Services are terminated and all outstanding Fees are paid in full, Genius Education Management will continue to charge the Authorized Card for applicable Fees.
  • We promise not to give your personal information to outside parties unless it's required to deliver our services. Private data is any data you provide to us that isn't accessible to the general public. After the purchase, data that was already in the public domain at the time of acquisition was entered there without our fault. It was legally compelled to be revealed or it was acquired from a source other than you without breaching any of our or their privacy obligations. It is not considered to be confidential knowledge.
  • Except as necessary in providing our services, we shall not divulge your sensitive information to third parties. Any information or resources you offer us that aren't publicly available is considered private data. Data already in the public domain at the time of acquisition entered the public domain without our fault after the purchase. It was obtained from a source other than you without violating our or their privacy obligations or was required to be disclosed by law. It does not qualify as secret information.
  • The day of your subscription renewal and the prepayment date (each is called a "Billing Date") will be the same if you choose to pay your subscription costs in advance. Genius Education Management will be the only party to determine the regular fees for Transaction Fees and Additional Fees. You will be charged for all outstanding costs that have not yet been paid on each billing date. The account owner will get a fee bill at the email address.
  • "Taxes" refers to any applicable sales, goods, and services (GST), harmonized or other taxes, fees, or levies that are either now in place or may be implemented by the federal, central, provincial, state, municipal, or other governmental entities.
  • You are in charge of paying any applicable taxes if you subscribe to or buy any of Genius Education Management's services and products while you are a resident of India. The applicable rates for the Indian billing address you give us will calculate these taxes. In addition to any fees for the associated goods and services, these amounts will be charged to your authorized card. If, by current legislative requirements, you are exempt from paying such taxes, you must present us with an original certificate attesting to your tax-exempt status. The tax exemption will only apply to the date on which we get such a certificate.

Cancellation And Termination

  • To begin the cancellation procedure, send an email to support. In response, Genius Education's management will provide comprehensive instructions on how to terminate your account. If cancelation is confirmed, portals acquired through Genius Education Management won't renew on their own. If you opt to cancel the Subscription in the middle of a billing cycle, We'll send out one last email invoice.
  • We reserve the right to make changes to or terminate your account. Your account will either be suspended or canceled if there is any fraud.
  • You can deactivate your Account at any time by emailing Support and following the detailed procedures provided in their response from Genius Education Management.
  • If either party terminates the Services for any reason:
    • Genius Education Management shall end your access to the Services and your Account;
    • Until and unless the Terms of Service expressly provide differently, you will not be qualified for any pro rata or other refunds of Fees;
    • Your Portal website will be shut down, and any outstanding fees for using the Services up until the termination date that are owed to Genius Education Management will become immediately due and payable in full.
  • Should you decide to stop the service later, you will get one final statement via email if there are any outstanding payments. Until that invoice has been fully paid, you won't be charged again.
  • We reserve the right to modify or terminate the Genius Education Management Service or your Account at any time and for any reason.
  • Fraud: Genius Education Management has the right, in addition to other remedies, to suspend or terminate your account if we have reasonable grounds to suspect that you have participated in fraudulent activity related to the site, whether as a consequence of an escrow inquiry, insurance, conviction, settlement or in any other way.

Third-Party Services

  • You use other third-party services at your own risk; we have no control over them. By using the smart education management platform, you accept that we may share your information with any third parties whose services you use. If you use them, you acknowledge that we are unable to provide any guarantees and will want to seek advice as soon as possible.
  • You additionally consent to be bound by any additional service-specific terms that may apply to services you may get from Genius Education Management partners or other third parties, in addition to these terms of service.
  • Genius Education Management may, at its discretion, recommend, permit, or grant you access to, for your consideration or use, third-party products, services, websites, applications, or "Apps" (collectively, "Third Party Services"). This access may be granted through the Genius Education Management App. The provision of these Third Party Services is purely for your convenience, and any Third Party Services that you buy, access, or make use of are solely between you and the relevant Third Party Services Provider ("Third Party Provider"). Before utilizing any Third Party Services, make sure to read the terms and conditions and/or privacy policies that apply to them. You use Third Party Services at your own risk and discretion, whether or not they are made available through the Services or Genius Education Management's website.
  • Regarding Third Party Services, we offer no guarantees. You understand that Third Party Services are beyond of Genius Education Management's control and that Genius Education Management will not be held responsible for any Third Party Services. Third-Party Services do not in any way imply or establish Genius Education Management's sponsorship, endorsement, or affiliation, nor does their inclusion or activation with the Services or presence on Genius Education Management's websites, including the Genius Education Management App Portal, imply such. We strongly advise you to get professional advice to make sure Third Party Services will meet your needs before relying on them.
  • Installing or enabling a Third Party Service for use with the Services does not transfer any ownership of data or create any other relationship between you and that Third Party Provider. You permit us to share your information with the relevant Third Party Provider and to take any other actions required to ensure that the Third Party Service is compatible with the Services by doing this. Genius Education Management shall not be responsible for any disclosure, alteration, or removal of your data or Portal Content, or for any consequential losses or damages you may suffer, as a result of a Third Party Service or Third Party Provider gaining access to your data or Web Content.
  • When it comes to any Third Party Services or your agreement with any Third Party Provider, including any Expert, Genius Education Management shall never be liable for any direct, indirect, incidental, special, consequential, punitive, exceptional, exemplary, or any other damages. Even if Genius Education Management has been informed that there is a chance that something could happen, these limitations will still apply. The following limitations will be in force to the maximum degree permitted by the applicable law.

Updates to the Service and Prices

  • At any moment, without incurring any obligations, we may modify or terminate the services.
  • With 30 days' notice, Genius Education Management reserves the right to change the cost of using the Services. This kind of communication can be given at any moment by posting the changes as an announcement on the administration menu of the Genius Education Management Site (http://www.geniuserp.com) or your Genius Education Management Portal.
  • Genius Education Management reserves the right to modify or terminate the Service (or any part of it) at any time and without prior notice.
  • Genius Education Management shall not be liable to you or any other party for any changes to the Service, changes in price, suspensions, or discontinuations.
